 The case was scheduled to be heard in the Pretoria High Court, this past Tuesday (27-05-03). At the centre of the dispute is a decision made by the Chief Inspector of Mines in January 2001, to classify the death, following injury, of a HIV positive miner Jose Mulungu Cossa, as a mine fatality and the resultant levy imposed on the mine. Khopotso Bodibe reports on the decision to withdraw the case.
